关于动物法律主体地位研究综述

必须加强对动物的保护已经是环境法学界和民法学界的共识,但动物是否享有权利却引起学者们的争论,动物是否具有权利的争论焦点就在于动物是否具有法律主体地位.有的学者从传统的法理学角度出发,主张通过赋予动物以特殊的法律客体或特殊物来加强动物的保护;有的学者根据法律主体在不断扩展的事实,基于人类应将道德关怀扩展到非人类的价值理念.认为要真正的保护动物必须赋予动物以法律主体地位.关于动物主体地位的讨论甚至涉及到法学研究范式是否需要从"主客体二分"转变到"主客体一体化"的深度,这些无疑都对法学的研究起到了推动作用.

A Review on the Legal Subject Position of Animals
