试论淮河治污的法律乏力与法律完善

“污染团”事件折射出淮河治污的失败。淮河治污凸现了刑法的相对虚化、行政处罚的相对弱化和民法救济的 困惑。要避免类似的悲剧事件再次发生,法律在治理淮河中应当及时修正,完善刑法关于破坏环境行为的规定,加大违 法的处罚金额,强化行政处罚的监督和建立行政救济制度。

On inability of law and perfection of law in reducing and controlling pollution in Huaihe River

"Pollution group" reflects the failure to reduce and control the pollution in the Huaihe River. The paper analyses its causes and concludes that in controlling pollution in the Huaihe River, criminal law shows relative inability, administrative law relative weakening and civil law puzzlement in relief. In order to avoid reoccurrence of such tragic events, laws should be revised, criminal law perfected concerning destruction of environment, fines for violation of law increased, supervision of administrative punishment strengthened and administrative relief system established.
