试论民事执行检察监督制度的建立和完善

“执行难”和“执行乱”是民事执行问题的集中体现，问题的根本原因是民事执行权力的过分集中，亟需强有力的外部监督，以防集权之弊，因此，民事执行检察监督应运而生。笔者拟从民事执行检察监督的产生背景及具备的优势出发，分析当前民事执行检察监督所亟待解决的问题，针对民事执行检察监督的若干问题提出自己的一些想法和建议，以期对民事执行检察监督的建立和完善有所裨益。

A Discusson on the Establishment and Perfection of the Civil Enforcement Procuratorial Supervision

＂Enforcement difficulty＂ and ＂enforcement disorder ＂ are the embodiment of civil enforcement problem,the primary cause of the problem is the excessive centralization of civil enforcement power. It is urgent to strengthen external supervision,therefore,the enforcement procuratorial supervision arises at the historic moment. From the background and advantages of civil enforcement procuratorial supervision,the author analyzes the current civil enforcement procuratorial supervision problem which requires immediate solution. Based on the civil enforcement procuratorial supervision problems,some suggestions are given to establish and perfect the civil enforcement procuratorial supervision.
