论思想因素在定罪量刑行刑中的作用——行为无罪,除非内心邪恶

思想不犯罪,行为是现代刑法的基础。但是单纯的行为归罪亦有多方面的不足和缺陷。必须充分重视思想意志在定罪方面、量刑方面、行刑方面的必要性和重要性。犯罪构成四大要件皆与意志自由密切相关,思想因素,又称意志自由因素或主观恶性因素,是定罪所必须考虑的重要条件,在量刑与行刑方面的重要作用亦不可小视。
