| 摘 要： | 我国刑事诉讼中普遍存在证人出庭作证率低的现象,究其原因与历史传统、社会环境、执法司法环节及我国刑诉法的相关制度构建的欠缺有关.为此,提出了建立证人保护制度,完善证人作证的法律保障,追究证人拒绝出庭作证的法律责任等立法构想.

| Abstract: | There are generally fewer witnesses to testify in the criminal case in our country due to the history ,social circumstance,law enforcing procedure and deficiency in the relevant ststems of criminal law.Thus,this paper proposes the following suggestions.First,to set up laws to protect the witness;second,to strengthen the laws on the witness liabilities who refuses to testify. |
