中国加入世贸组织与外资立法的完善

入世后的中国外资立法与WTO投资规则的衔接问题十分关键.首先,以与投资活动相关的WTO基本原则为指导,分析了我国外资法的现状及问题,如多头立法、内外资立法的双轨制、立法体系的相互冲突、缺乏透明性等,并对外资法中与WTO投资法律规则不一致的内容进行了审视,阐述了WTO投资协议对我国外资法所带来的深刻影响.最后,就完善我国外资立法以及外商投资法典的制定问题,从宏观和微观上提出了若干法律思考.

WTO and the Perfection of China's Foreign Investment Laws

It's vital for our foreign investment law to meet the WTO rules and principles after China's entry into WTO.Guided by the WTO investment related principles and combined with the analysis of the present Chinese foreign investment legislation,this paper discusses the contents which conflict with WTO rules and points out the impact upon the Chinese foreign investment legislation by China's entry into WTO.Finally,it puts forward some proposals on the perfection of the foreign investment laws from both the macroscopic and microcosmic perspectives.
