行政诉权及其保障

现行行政诉讼法修改的必要性已是不争的论题。笔者认为修改现行行政诉讼法应以保障相对方的诉权为宗旨和立足点。从行政诉权的内涵及其性质 ;行政诉权的价值和功能 ;保障行政诉权之理据 ;行政诉权的立法保障与司法保障四个方面分别进行论述。

Administrative Liti gation Right and Its Assurance

It is incontrovertible that the current administr ative procedure law should be revised. It is argued that the revision of the cur rent administrative procedure law should be based on the assurance of the litiga tion right of the citizens. This is approached to in this paper from four angles : the content and nature of administrative litigation right; the value and funct ion of administrative litigation right; the basis of assuring administrative lit igation law; and the legislative and judicial assurance of administrative litiga tion right.
