刍议我国逮捕制度的完善

为保障刑事诉讼的顺利进行,需要建立逮捕制度的强制犯罪嫌疑人到案。世界上大多数国家设立了有证逮捕和无证逮捕,由中立的司法机构进行审查,采取事前审查和事后审查相结合,逮捕与羁押分立,当事人对逮捕有完善的救济途径。而我国目前逮捕制度的缺陷是由追诉主体决定逮捕导致逮捕的滥用,逮捕与羁押合一问题严重,当事人救济途径虚化,因此需要加以完善。
