网络环境下著作权合理使用制度的新形式

合理使用是各国著作权法的通行制度。互联网络的出现,使得大量的数字化材料被简便、高速、高质量、低成本地复制,并能在全球范围内被用户访问和下载,因此它不可避免地带来诸多问题。讨论了如随机存储器即内存中的复制、缓存、电子邮件、新闻组、电子布告板、数字图书馆及远程教学的合理使用等问题,指出这些问题的解决,必将丰富我国著作权法中合理使用的内容。

New Types of the Fair Use of the Copyright in the Network Environment

Fair use is the prevalent system in the law of copyright of all countries. The appearance of Internet has caused amounts of digital sources to be copied easily,quickly and cheaply. They can also be visited and loaded down by every user in the global sphere. Therefore many problems have come out inevitably. This paper discusses the fair use of RAM ,CACHE,E-mail,Newsgroup ,BBS, digital library and remote teaching, and points out that the solution of these problems will contribute much to the Chinese copyright law.
