技术转移中的知识流和知识产权分析

论文首先从知识载体之间和知识载体内部两个角度,具体分析了技术转移中的复杂知识流,指出了技术转移过程中知识流的两种形态嬗变。在此基础上,提出了技术转移中的两个根本性问题,即由知识流的组织专属性的嬗变所带来的技术转移中权力的部分让渡,和由知识流从公共知识向私人知识的转化所带来的技术转移中利益的重新分配。论文最后从知识产权的规制和管理方面给出了促进技术转移、加速知识流动的建议。

The Analysis on the Knowledge Flow and Intellectual Right in Technology Transfer

Firstly,the paper analyzes the complicated knowledge flow in detail in technology transfer from the points of view of among knowledge carriers and inside knowledge carriers.Then,it indicates two kinds of changes of the knowledge flow in the process of technology transfer.Based on this,the paper considers that there are two essential issues in technology transfer: one is the partial assignment of intellectual right,arose from the change of the property between the organizations in the process of knowledge flow;the other is the interest re-distribution,arose from the process of knowledge flowing from the public field to the private field.Finally,the paper make some suggestions to advance technology transfer and knowledge flow from the aspects of the establishment and management of intellectual right.
