试论莱布尼茨的自然法体系

莱布尼茨自然法三原则暗示了其法学思想与其哲学思想及其所处时代的联系。此外,莱布尼茨自然法体系三原则每一原则都成立,但作为一个体系却构成冲突。对此莱布尼茨尝试运用其＂可能世界＂理论背景下的道义逻辑对这一冲突进行解决。运用莱布尼茨法律思想,可以发现当代法学研究可能存在的一些新的视角。

On the Natural Law System of Leibniz

Three principles of natural law created by Leibniz imply the connection of his jurisprudence with his philosophy and the age he lived in.Every principle of Leibniz can be proved alone,but three principles conflict with each other when they constitute a system.Leibniz attempted to solve this problem with his moral logic backed by his possible world theory.With Leibniz＇ legal thoughts,some new perspectives of present law research can be discovered.
