| 摘 要： | 父权中的送惩权是家族法中有代表性的制度之一,从秦律开始,有了明确的记载。本文选取了秦简《封诊式》中的两则案例进行分析,归纳出古代送惩权的理论基础和历史演变,从而反映出传统法律家族本位的特质。
