| 摘 要： | 表见代理本是一种无权代理，但却产生与有权代理相同的后果。随着市场经济的不断发展，表见代理制度的设立充分保护了善意相对人的信赖利益和交易安全。本文从表见代理的概念、发展概况、构成要件、法律后果等方面进行了阐述，并简要分析了设立表见代理制度的意义所在。

| Abstract: | The agency by estoppels originally is one kinds unauthorized agency,but produces actually the same consequence with authorized agency.Along with market economy increasing development,establishment of the agency by estoppels system fully protect the good intentions relative person's faith benefit and the transaction security.This article details the concept of the agency by estoppels,development survey,constitutive requirements and legal consequence and briefly analyzes the significance of establishment of the agency by estoppels. |
