| 摘 要： | 被害人承诺的有效成立，直接涉及到行为人刑事责任的有无和大小，只有严格区分和限定被害人承诺有效成立的条件和范围，才能更好地指导司法实践。对于被害人承诺的成立，主要从被害人承诺的主体、可以承诺的对象以及行为人是否存在对承诺行为的认识等方面进行探讨。

| Abstract: | The effective establishment of the victim's permission is closely related to the availability and degree of criminal responsibility.Therefore,strict discrimination and limitation of the condition and scope of the victim's permission can better guide judicial practice.As regards to the establishment of the victim's permission,the paper focuses its discussion on the promisee,the promised and the undertanding of the doer for the permission,etc. |
