民事检察监督制度述评

民事检察监督制度主要以分权、防止司法专断、维护社会公益、实施法律监督与保障司法公正为价值目标。我国民事检察监督制度在诉讼法理和制度构造上还存在诸多问题,其改革的路径应当是：增加检察机关代表国家利益和社会公益提起诉讼或参与诉讼；增加检察机关对民事执行案件的检察监督；加强检察机关对法院审判程序的监督；严格限制检察机关对审判结果的监督。
