共同侵权之“共同”的认定标准

我国《侵权责任法》第8条对共同侵权的共同标准仅做了抽象性的规定,鉴于理论上各种共同标准存在的缺陷,笔者认为将意思联络说作为共同侵权的共同标准能最大程度地体现责任原则和公平价值。与此同时,由于连带责任与共同侵权二者并非必然联系,对无意思联络数人侵权在符合自己责任原则的情况下,使行为人承担连带责任也利于保护受害人利益。
