浅议我国印证证明模式下的自由心证

我国刑事诉讼的“印证证明模式”下的自由心证以追求案件真相为价值取向,立法制定了较高的证明标准。这导致在司法实践中缺乏可操作性,不利于发现案件真相,保护被告人的权益。在探讨自由心证制度的基础上,结合我国证据制度的实际情况,建议对我国的自由心证制度进行重构。
