Traditional theory mainly explain the origin of the third sector from its function between market failture theory and government failure theory. But it is not sufficient to demonstrate the reason for the development of the third sector, especially the reason that the third sector provides private goods. Contract failure pays more attention to the third sector itself from the institution needs respect. It shows the necessarity of the third sector existing and makes up for the lack of the explanation that market failure theory and government failure theory had made. Contract failure provides the a more convincing theoretical basis for the development of the third sector and removes the obstacles for its development.
