| 摘 要： | 互联网的发展对著作权制度造成了极大的冲击,著作权制度“利益平衡”的基本原则受到了影响。针对互联网的特征,现有的著作权法必须适应技术的发展而做出调整。对互联网上的著作权既要“保护”又要“限制”,以维护著作权人和社会公众之间的“利益平衡”,从而实现著作权立法的基本宗旨和目标。

| Abstract: | The development of Internet engenders a great impact on the copyright system. The basic principle of the "equilibrium of interests" of the copyright system has therefore affected.Against the Internet characteristics,the present Law of Copyrights must be adjusted to the development of technology.The copyrights on the Internet shall be both "protected"and "restricted" to achieve the "equilibrium of interests"between the copyright owners and the public,and consequently attain the basic legislative aims and objectives of copyrights. |
