| 摘 要： | 亲属相容隐是中国古代法的一个重要组成部分.亲属相容隐制度与我国现行刑法在传统道德、伦理基础、根本目的乃至制度层面都具有契合之处,在我国现行刑法之中应当一定程度的恢复亲属相容隐制度.
