珠三角地区劳动者社会保险权的现状、困境与对策

《社会保险法》实施后，社会保险权在珠三角地区的保障情况并没有预期理想，在一线劳动者群体中，特别是在劳务派遣劳动者群体中，社会保险制度仍然没有得到全面覆盖。社会保险实施存在不少现实障碍，究其原因主要有：配套管理技术手段落后；社会保险转移接续难；相关主体的不同利益导向导致社会保险权难以实现；对《社会保险法》宣传不足，劳动者在认识上出现偏差；等等。针对以上情况，应当完善社会保险方面的立法、行政与司法体制，加强社会监督并引入工会为代表的诉讼，构建畅通的社保转移接续机制，严格控制劳务派遣单位的市场准入和保障劳务派遣劳动者的社会保险权益。

The Social Insurance Rights Present Situation,Predicament and Counter Measures of the Labor in the Pearl River Delta Area

Prospective effect was not attained after implementing the Social Insurance Law in the Pearl River Delta Area. The front-line workers, especially the Labor Services Dispatching, don’t aware of its harmfulness and the implementation of social insurance. The main reasons are：the backward of supporting management technologies;the difficulty in transferring social insurance records;the hardness in achieving rights of social insurance caused by different subjects’ interest-orientation;workers’ misunderstanding caused by lacking of publicity on the Social Insurance Law, and so on. In view of the above mentioned situations, we should perfect social insurance’s legislation, administration and judicial system, strengthen social supervision and acknowledge Trade Unions representing the workers in relative lawsuits, construct a reasonable transferring mechanism of social insurance, strictly control market access right among the labor dispatching and service providers, and protect the social insurance rights and interests of workers indeed.
