| 摘 要： | 1999年新<合同法>第一次以法律的形式在我国完整地确立了表见代理制度.尽管如此,我国学术界对表见代理的法律价值、理论基础等方面仍有较大的分歧.本文结合两大法系表见代理制度与我国表见代理制度的相关规定和现有理论研究成果进行了探讨,提出了一些个人见解.
