试论道德建设的法律基础

道德与法律的内在联系以及道德规范的他律性和法理性，要求在道德建设过程中，必须借助法律的力量。但在长期的道德建设中，由于缺乏法律的基础和忽视法律手段的辅助作用，以致社会转型期的道德建设出现软弱的局面。为改变这种状况，我们必须强化道德建设的法律基础，从而提高道德的他律意识、增强道德规范的他律作用和优化道德实施的外部环境。

On the Legal Basis of Constructing Morality

Due to the inner links between morality and law as well as the other-limitation and legality of morality, the legal force should be involved in constructing morality. However , a weak situation in constructing morality is come up in the social transformation since we lack the legal basis and have ignored the assisting role of law for a long time .To improve the state , we should solidify the legal basis of constructing morality , then we can raise the awareness of other-limitation, and strengthen the function of moral and optimize the external conditions for moral practice .
