论期刊全文数据库的有关版权问题

期刊全文数据库是将各种期刊发表的文章原版原文地制作成电子数据库，从而原汁原味地以数字化形式再现传统期刊上的文章．从其特点可以看出，期刊全文数据库不是著作权法中的“汇编作品”，由于其不具有“原创性”，其法律属性应为“非原创性数据库”．“非原创性数据库”由于缺乏原创性而无法获得著作权法的保护，因此，期刊全文数据库其本身不具有相关的著作权，其若要取得相关著作权只有通过作者和期刊社的授权才能获得．在作者和期刊社授权的过程中，由于各当事人所处的地位失衡，容易造成相关权利人无法得到对等的权利，甚至连侵权行为还在悄然“合理”地存在着．

Comments on the Copyright of Periodical Full-database

Periodical full-database is the electronic database of the original papers published in various periodicals, so it is the representation of the original papers in traditional periodicals in digitalized form. Periodical full-database in this paper is treated as non-original database rather than compilation of works for its lack of originality, non-original database cannot acquire copyright protection. Therefore, periodical full-database has no relevant copyright, and it can only acquire copyright via the author＇s and the periodical press＇s authorization. However, during the authorization, because the imbalance of each party, the unequal rights between the author and the press and even the covert ＂rational＂ exist.
