刑事附带民事诉讼中确立民事侵权精神损害赔偿制度的法律思考

精神赔偿在我国法律中历来为众多的学者所关注,但由于我国在立法权上的不统一和违宪审查制度的不完善,导致实践中精神赔偿呈现出差别待遇,特别在刑事案件中,受害人仅仅得到物质赔偿,而精神上的痛苦却无人问津,在构建和谐社会的今天,我们不仅追求高度发达的物质生活,更希望有丰富的精神享受,当今民事违法责任的承担包含精神赔偿,而刑事犯罪责任的承担对受害人而言却只有物质上的补偿,令人难以接受和信服。原因何在?笔者就此问题仅以该文提出个人看法,供大家参考。

The spiritual compensation always be paid attention in our country's law by the multitudinous scholars,but because our country not unified and the violation of the constitution review mechanism is imper- fect in the legislative power,causes in the practice the spiritual compensation to present the discrimination, specially in the criminal case,the victim merely obtains the material compensation,but in the spiritual painful actually nobody will ask.In construction harmonious society's today,we not only pursues the highly developed material life,but also has the rich spirit to enjoy.Now the civil illegal responsibility undertakes contains the spiritual compensation,but criminal offense responsibility undertaking actually only then on the material com- pensation speaking of the victim,makes one accept with difficulty with the belief.Why?The author only pro- poses individual view on this question by this paper,for everybody reference.
