法治的法学方法论之维

近代以来的西方法治不仅建立在西方悠久的自然法思想传统的基础上,而且建立在古罗马人所创立的法学或法律科学的传统的基础之上。中国大陆学者往往只认识到前者而很少论述后者。但是,法治不仅仅意味法律是良法,而重要的是良法能够得到切实有效地实施。如果说自然法理论为良法确立了价值标准,那么建立在古罗马法学基础上的法学方法论是保障良法能够得到切实有效地实施的理论。

The Dimension of Methodology of Jurisprudence for Ruling by Law

The modern ruling by law in the West was not only based upon the tradition of natural law,but also on the jurisprudence or science of law created by ancient Romans.Usually Chinese scholars pay attention to the former one only,but not the latter.However,what ruling by law means is not only that law is good,but also that the good law is effectively enforced and implemented.If it is true that the theory of natural law establishes criterion of good law,the methodology of jurisprudence resulting from the Roman jurisprudence is the theory ensuring effective enforcement and implementation of good law.
