公司的利益相关者与股权保护

从性质上讲,股份公司是所有权的一种实现形式,所以我国现在公司的最重要的问题是投资者保护问题,而非利益相关者问题;相关者利益不是一个承认不承认的问题,而是一个实现方式、实现途径的问题,可以基于经济关系、企业伦理、公共关系等多角度去处理。在公司治理的方式中,股东通过董事会的监督属于事中的、过程性的监督,能够最有力地对股权进行保护。
