当前农地流转的“反公地悲剧”及其治理对策

我国农村土地集体所有，具有公共资源特征，即“公地”特性。由于土地权能分散、权属不明确，导致土地流转不顺畅、欠规范，引发了“反公地悲剧”。因此，应采取扩大农户的土地权能、完善土地流转政策法规、培育土地流转市场、健全农村社会保障体系等对策，从而加快土地流转，保护农民的土地权益。

Research on "The Tragedy of Anti-commons" of Current Rural Land Transfer and its Governing Countermeasures

The collective ownership of rural lands in China has the characteristics of public resources,namely,the characteristics of "commons land".The dispersion of land rights and the not clear ownership of land lead to not smooth and irregular land transfer,which causes "The Tragedy of Anti-Commons".Measures of expanding farmers’ land power,improving land circulation policies and regulations,cultivating land circulation market and perfecting rural social security system should be taken to accelerate land transfer and protect the interests of peasants.
