| 摘 要： | 有效保护商业秘密必须首先科学合理地规制商业秘密的构成要件。本文在比较中日法律对商业秘密的界定的基础上，分析了我国相关法律规定的不足，并提出了相应的完善措施和立法建议。

| Abstract: | Protecting trade secret efficiently must speculate the constitutive elements of trade secrets in a scien- tific and reasonable way. Based on the comparisons of Sino-Japanese definition of trade secrets, this paper analyzes legal deficiency of our country. Then it puts forward the measures of the perfection of trade secret protection system and the proposals of the establishment of a sound, robust legal system. |
