试论我国知识产权质押的金融风险及其防范

权利质权已经成为当今社会重要的担保物权之一,并为物权法所认可。随着知识产权日益发展,知识产权质权也逐步成为主要的权利质权供当事人提供质押。尽管近三十年来知识产权法在我国不断取得进展,但是其在制度上仍存在不足之处。金融机构为了防范金融风险而更多地选择不动产作为质押标的,权利质押成为中小企业质押融资的主要途径。知识产权质押作为新兴的权利质押方式,更应发挥其应有的作用。减少知识产权质押存在的金融风险,以及如何去防范金融风险,是值得研究的问题。

On Financial Risk and Prevention of the Pledge of Intellectual Property

Right of pledge has become one of the real rights for security in today＇s society and it is authorized by the law of property. With the growing development of intellectual property, the pledge right of intellectual property have gradually become the major pledge right for the parties to provide collateral. Although the development of intellectual property law continued to make progress for nearly 30 years, deficiencies still exist. Financial institutions prefer to choose real property as collateral in order to prevent financial risks but pledge of rights is the main way for many companies. The pledge of intellectual property as an emerging right should play its role. Reducing and preventing the financial risk existing in the pledge of intellectual property are worth studying.
