| 摘 要： | 市民社会视野下的财产权是自由与个人自治的客观基础,更是大力发展商品经济的前提条件,然而我国“大公无私”的文化传统导致现实中私有财产处于十分脆弱的地位,经常遭到所谓的公权力的侵袭。有鉴于此,私有财产的充分保护理应成为我国所致力构建的市民社会的核心目标之一,而在当前形势下,正在制定过程的物权法也实需对此问题予以高度的关注。

| Abstract: | In the eyes of the civil society,the right of private property is the foundation of personal freedom,and also the premise of the development of communcial econemy.However,because of our custom,the private property is very weak in real life,and is often attacked by power.So,protecting the right of private property should be one of the subjects when we construct civil society.And in the course of drafting Property Law,we must pay attetion to this problem. |
