论合同相对性原则的例外

作为合同规则和制度赖以存在的基础和前提，合同相对性理论在合同制度中的地位尤为重要，整部合同法也贯穿了这一原则。但随着商业交易的不断发展，合同相对性理论被不断突破：第三人利益合同、附保护第三人作用之契约、利益第三人担保责任、第三人侵害债权制度、合同保全及租赁物权化等制度共同体现了合同的涉他效力，对传统合同相对性理论提出了挑战。

On contract exception of the relativity principles

As a system of rules and contracts on which the foundation and prerequisite for the contract theory of relativity in the status of the contract system is particularly important, the entire contract law also runs through this principle. But with the continuous development of commercial transactions, contracts are experiencing relatively constant breakthroughs in theory ： the interests of the third contract, the protection of the role of the third contract, responsibility for the security interests of a third person, the third person claims against the system, contracts and protection of property rights and leasing system which all embody effectiveness of contracts. This challenges the theory of relativity of traditional contracts.
