网络银行若干法律问题研究

金融电子化随着互联网的开发与利用已是一种世界性的潮流,网络银行便是电子金融化中的一种模式。自从全球第一家网络银行诞生后,网络银行得到了迅速发展,目前网络银行业务正全面取代PC银行业务。网络银行业务在突破传统银行业务理念的同时,也对传统的法律制度产生了巨大的冲击与挑战,如网络银行的市场问题、网上贷款问题、税收征管问题、电子签名的法律效力问题等。这些问题得不到解决,将会严重阻碍网络银行的发展、应用及普及。我国应尽快制定和完善相关的法律以规范其发展。

Research on Law Questions on Network Banks

The electron finance is a kind of popularity in the world. With the use and development of internet, network bank is a model of that. Since the first network bank was born, it has developed quickly. Now network banking is placing PC banking gradually completely. Internet banking has made a great breakthrough in the traditional banking with huge impact and challenge to the present law which consists in the following aspects: the problem of market access of network bank, the problem of network loan and tax, the effect of electronic sign. These problems should be resolved quickly, otherwise, they will provent the development of network bank. Our country shuold regulate and perfect relational law to control it.
