我国近期揭露的一系列食品安全问题表明,传统法人犯罪控制策略面临风险社会的严峻挑战:一是对"重刑主义"刑罚观的挑战,二是对法人犯罪中责任主体与责任分配原则的挑战。因此需要引导公众认同法律规范价值,加强行业监督与监管层级,划定法人责任与雇佣责任的范围,正视风险社会的结构品质,在风险社会的结构性困境中完善归责体系,以期取得法人良性发展与社会安全的双重收益。
