| 摘 要： | 我国《国家赔偿法》采用的是抚慰性赔偿原则，惩罚性赔偿制度的缺位导致该法实施效果不佳。《国家赔偿法》中引入惩罚性赔偿具有一定的理论基础和现实基础，国家财力有限、国家哲学观念等问题不会成为引入惩罚性赔偿的实质障碍；构建惩罚性赔偿制度时应在“故意或重大过失”的情形下适用。

| Abstract: | China's Current state compensation standard only uses consoling standard and can not be effectively implemented in the state compensation law,especially because of the lack of punitive damages.It is rational that the punitive damages should be established in the state compensation law on basis of theory and reality.State financial finity and State philosophy view should not be essential obstacles.In the case of intent or serious blame we can apply the punitive damages. |
