| 摘 要： | 图尔敏的论证模式包括主张、根据、保证、支援、可能的反证和模态限定词。主张是论证的起点,主张的类型决定根据。从根据到主张需要保证,保证一定程度上支持从根据到主张的步骤。当保证的可靠性和相关性遭到挑战时,我们需要为保证寻求不同类别的支援。考虑到例外,需要可能的反证。最终的陈述不可避免地需要模态限定词。

| Abstract: | Toulmin’s model of the argument in the legal aspects of application has extensive significance.Toulmin’s model and its argument about constitute factors are analyzed.Toulmin’s argument model includes claim,proof,guarantee,support,rebuttal and modal qualifier.Claim is the starting point of the argument.The type of claim determines proof.Guarantee is needed from proof to claim.When the reliabilities and correlations of guarantee were challenged,we need to seek for different types of support.Considering the exception,rebuttal may be needed.The final statement inevitably needs modal qualifier. |
