论我国现行破产管理人制度的缺陷与完善

由于我国现行破产制度对破产管理人未作科学的定位,导致这一制度在司法实践当中缺乏可操作性。本文试图运用比较分析的方法,在深入剖析我国破产管理人制度缺陷的基础上,结合国外先进的立法实践与我国的现实国情,对我国破产管理人制度提出一些粗浅的立法建议。

On flaw and consummation of bankrupt supervisor system in our country

In our country,present bankruptcy system has not had the scientific localization of the bankrupt supervisor,so it is lack of feasibility in the judicial practice.Based on the analysis of the supervisor system flaw in our country,this article attempts to utilize the comparative analysis method,considering the overseas advanced legislation practice and our country's realistic condition,puts forward some shallow legislation proposal to the bankrupt supervisor system.
