教育法经济分析的若干问题

摘    要:教育法的经济分析把效益的概念引入法学领域,并将其作为一种价值取向,强调教育法是一种经济资源,其实施应当以有利于社会财富最大化和效益最大化为目标并运用微观经济学的原理和方法将事前分析的方法引入教育法学研究,对新法的制定、实施和教育法律规则的修改后果进行事先分析和预测,避免教育法律法规制定和修改过程中的重大失误等均有重大意义.

Abstract:In the aspect of value prospective, the economic analysis of education law brings efficiency into the field of law and takes it as one of the worth orientations, it emphasizes that education law is one of economic sources. The effectuation of education law should be beneficial to the objects of maximum of social treasure and efficiency; As to the method introduction, the economic analysis of education law introduce the method of pre-analysis into the study of education law by virtue of the principle and method of micro-economics, and make a pre-analysis and forecast to the formulation and implement of new law and the amended result of education law and regulations, the purpose of which is to avoid the serious mistakes in the process of the formulation and amendment of education law and regulations.
