论西方法学教育的起源

学界一贯认为西方法学教育肇始于古罗马时期.诚然法学教育在古罗马时期已经出现,并有了相当完善的发展,但究其起源则应追溯至古希腊时期.无论从古希腊法学思想方面,还是从其经济、政治、教育发展方面,都具备了产生西方法学教育的条件,事实上法学教育在古希腊也已经存在.所以,西方法学教育的起源是在古希腊,不在古罗马.

On the Origin of Western Legal Education

Academia has always maintained that the Western legal education begin in ancient Roman period. It is true that the legal education has appeared in Roman times, and has a perfect development. However, the study of its origin should be traced back to the ancient Greek period. No matter in legal thoughts or economy, politics and education, there are some conditions in ancient Greece which can pave the way to the origin of western legal thoughts：In fact, the legal education existed already at that time. So, the Western legal education originated in ancient Greece instead of Rome.
