| 摘 要： | 自由与秩序并非一对冲突的法律价值。自由与秩序法律价值的冲突,实质上应为自由与存在于法律秩序中的其他价值追求的冲突。秩序价值是自由价值形成的基础,人们通过法律在获得自由价值的同时必然也相应地获得秩序价值;同时,秩序价值必须依附于其他价值而存在,抽象的、不包含其他价值的秩序价值是不存在的。
