| 摘 要： | 不能犯问题由于在我国刑事立法中没有明确规定,给司法实践带来了很多争议,侵犯人权的现象时有发生。针对我国刑法理论关于不能未遂犯的含义、本质及存在的不完善之处等几个问题的研究,得出我国不能未遂犯的应有含义,即不能犯并非均构成犯罪,而可分为不能犯未遂与不可罚之不能犯。
