许可协议中的知识产权滥用及其规制--由DVD事件引发的法律思考

DVD专利联合许可在一定条件下属于对知识产权的正常行使。但当它妨碍了竞争,它不仅是对知识产权的滥用,而且还会落入反垄断法适用的范围,即可能构成限制竞争协议或滥用市场支配地位。然而,由于我国目前尚无一部独立的反垄断法,使我国对此规制处于空白状态,其结果将导致对不断出现的类似事件的失控,并将制约我国市场经济的发展。为遏制对知识产权的滥用,制订我国反垄断法已刻不容缓。

Abuse of Intellectual Property Rights in Contractual License and Its Regulation --Legal views from DVD Conflicts

DVD joint patent license(patent pool) is a reasonable enforcement of intellectual property rights under some preconditions.Since it hinders the competitions,not only intellectual property rights might be abused but also the agreement in restraint of competition or the abuse of market-dominant position will be formed.It violates the anti-monopoly law.Because there is no anti-monopoly law in China,no rule could be used to regulate it which causes the similar things take place again and again and finally restricts the development of Chinese market economy.In order to contain abuse of intellectual property rights,it brooks no delay to enact anti-monopoly law.
