| 摘 要： | 班固《汉书.刑法志》参考了《荀子》之《王制》《议兵》《正论》观点。对比可见：班固极力赞赏荀子的刑法思想,在刑法起源、刑法与礼义关系以及是否有象刑这三个方面,班固受到荀子的启发;与荀子完全不同的是,班固还从形而上的角度探讨了刑法的起源;班固对荀子思想的接受,正是汉代礼治与法治并重的社会实践在理论界的反应。

| Abstract: | Bangu appreciated the idea of criminal law in Xunzi.He accepted the idea of the origin of criminal law,the idea of relationship between criminal law and ceremony,and the idea of whether there was symbolic punishment in history.Be completely different from Xunzi,Bangu explored the origin of the criminal law from the metaphysical perspective.In Bangu s opinion,the theory of Xunzi was theoretical guide of political practice of Han Dynasty. |
