论侵权法严格责任归责原则——以法经济学为分析进路

现代意义上的侵权法严格责任，是作为相对于过错责任的责任规则产生并发展起来的，但它不是过错责任的简单轮回，而是更高一级的责任。本文试图采取法律经济学的视角，分析严格责任的产生和发展，并从经济学的角度分析其在不同情况下的利弊，以期找出最佳的适用条件和范围，实现社会成本的最小化。

On the principle of strict liability of torts --Taking legal economics analysis as the starting point

Relative to fault liability doctrine,modern strict liability of torts brings about and develops,which isn't a simple reincarnation of fault liability,but a higher level responsibility.This article attempts to analyze the emergence and development of strict liability from the perspective of law-economics,and analyzes pros and cons in different circumstances from economic viewpoint,hoping to find the best applicable conditions and scopes and to achieve the minimum of social costs.
