论我国占有保护请求权体系之构建

占有作为一种事实状态体现了财产秩序，法律之所以要保护占有，是为了维护社会财产秩序和生活秩序的稳定，并非是为了寻求对真正权利人的保护。占有保护请求权不同于物权请求权，它是以保护占有的现实状态为宗旨的独立的请求权。占有保护请求权包括占有物返还请求权、占有妨害除去请求权、占有妨害防止请求权、损害赔偿请求权。在立法中如何规制占有保护请求权是一个不可回避的问题。构建我国占有保护请求权体系，对于占有制度理论的发展和完善的构建有着重大的现实意义。

Possession reflects the order of the property status. The reason to protect the possession of the property is to maintain social order and stability. The claim of possession of property is different from the claim of real right. The claim of possession of property is an independent right to protect the actual state of possession. The elaim of possession of property includes the right to ask for returning the possession, the right to ask for removing the interference, the right to ask for preventing the interference and the right to ask for damages. How to protect the right of possession is an unavoidable problem in the legislation. So it has great realistic meaning to building claim system of possession protection for development and perfection of the possession system.
