| 摘 要： | 无限防卫是一项重要的法律制度。规定无限防卫十分必要。它有利于公民同严重危及人身安全的暴力犯罪做斗争。无限防卫有自己独特的构成要件。防卫人必须具有防卫合法权益的意图;必须有某种特定暴力犯罪的存在;必须是针对正在进行的特定暴力犯罪;必须是针对不法暴力侵害者本人实施。在适用无限防卫时,应注意对“行凶”和“其它严重危及人身安全的暴力犯罪”的认定。

| Abstract: | The unlimited defense is an important legal system.It is necessary to formulate it,which contributes to citizens' fighting against the violent offence that imperils grievous personal safety.The unlimited defend has its own's unique conditions.The defender must have intention to safeguard lawful rights.He must have the specific violent offence existing.He must counter the particular violent offence on the spot.He must be directed against the illegal violator.Using the unlimited defense,pay attention to identification of"Committing murder"and"violent crime to imperil grevous personal safety". |
