| 摘 要： | 在专利申请中披露遗传资源的来源是促进<生物多样性公约>目标的实现与遗传资源的获取和惠益分享法律规范实施的重要措施.就披露要求的目标而言,披露要求可以阻止对于遗传资源的不当利用以及确保遵守事先知情同意和惠益分享的义务.关于披露要求的范围,披露要求可能覆盖二个方面的与请求保护的发明有关的信息.披露要求的启动主要解决的是遗传资源与请求保护的发明之间的关系问题,但是现有的立法和建议对此存在较大的争议.

| Abstract: | Disclosure of origin of genetic resources in the patent application is an important measure to promote the realization of the aims of Convention on Biological Diversity and the implementation of legal rules of access to genetic resources and benefit sharing. As far as the aim of disclosure requirement is concerned, disclosure requirement can prevent misappropriation of genetic resources and ensure that the obligations of prior informed content and benefit-sharing are complied with. As for the scope of disclosure requirement, disclosure requirement may cover two kinds of information related to the claimed invention. The trigger of disclosure requirement resolves mainly the relationship between genetic resources and the claimed invention, but there are a lot of controversy among existing legislations and suggestions. |
