论建立自然人破产制度的必要性——对我国新破产法适用范围的思考

新破产法将自然人排除出适用范围的做法，不符合国际潮流和我国的现实需要。自然人破产制度在当代有独特的价值和功效，建立自然人破产制度不仅符合破产法的历史发展规律及趋势，有利于实现破产制度价值，而且能够满足社会经济发展的需求和实现法律内部协调，并对于促进市场经济体制的完善和实现主体间平等保护有着不可或缺的意义。建立自然人破产制度所要克服的困难，不能成为否定自然人破产制度产生的理由。

It is important to perfect the system of the marked-based economy and achieve equal protection of different person.
