| 摘 要： | 有关罚金刑执行的研究是一个历久而常新的课题,它需要理论和法律实践的长期磨合。现从人权保障角度,论证了罚金刑执行与人权保障的相辅相成关系,指出了罚金刑执行中存在的罪犯权利缺损现状,并为克服这一弊端探寻了解决的三条途径:第一,明确罚金刑执行主体;第二,完善罚金刑执行立法;第三,规范罚金刑执行程序。

| Abstract: | The study on execution of fine punishment is a permernant and new research topic which calls for the combination of theory and law practice. It argues the relationship between extcution of fine punishment and guarantee of human rights from the angle of human rights. And it points out the lack of criminal's rights in such execation. Eventually, several solutions have been put forward: first is to clarify the subject who execute fine punishment; second is to better and legislate fine punishment; third is to standardize the regulation of fine punishment. |
