宪政视野下中国司法腐败问题探析

在特定的时空关系中，司法腐败受到司法体制不当的影响即司法权的异化的影响，所以司法腐败不仅仅是司法机关、司法人员出于故意，违反法律、法规、司法职业纪律、司法道德，损害司法关系或者司法权的行为。现今中国的司法腐败一定意义上是一个宪政问题。遏制司法腐败不但应理顺司法体制，而且要提高立法质量。

Discussion on China＇ s judicial corruption in the perspective of constitutionalism

In specific time and space relations, judicial corruption is the result of improper judicial system, namely the alienation of judicial power. Therefore ,judicial corruption is not just an intentional act of judicial organs and judicial staff to violate the law, regulations, judicial discipline ,judicial morality and undermine judicial power. In China today judicial corruption is a constitutional issue. To stop judicial corruption, judicial system should be straightened out and quality of legislation should be improved.
